Pension credit backdating rules
If you do not agree with our decision, you can ask us to look at it again or you can appeal against it.
You must write to us within one month of getting our decision.
Housing benefit or council tax reduction is usually paid from the Monday after we get your claim form.
If you can show ‘good cause’, we may be able to pay your benefit earlier than this. Good cause must be continuous for the period you want benefit backdated for.
Pension Credit is the principal element of the UK welfare system for people of pension age. It was introduced in the UK in 2003 by Gordon Brown, then Chancellor of the Exchequer.
It has been subject to a number of changes over its existence, but has the core aim of lifting retired people of limited means out of poverty.
Sometime in your life you may be in need of the support provided by social security benefits.
The value of Guarantee Credit, and Savings Credit are automatically uprated each year, in line with inflation, as is the basic State Pension, and Second State Pension (S2P).
The Housing element would be based on Local Housing Allowance, in a similar manner to Housing Benefit, but payments would be incorporated within Pension Credit, rather than being a separate benefit claimed from the local council.
It is not clear when, or if, this plan will be implemented.
This process is not backdating, it is what the law says must happen when you apply.
This rule also applies to men over pension credit age but less than aged 65 who are NOT in receipt of Income Support, Job Seeker’s Allowance (Income based) or Employment and Support Allowance (Income Related).
According to Age UK more than a third of those entitled to claim Pension Credit fail to do so based on latest estimates of take-up from 2009/10.
